Of Withered Apples by Philip K. Dick is PUBLIC DOMAIN.
First published in Cosmos Science Fiction And Fantasy. This short story was not previously known to be public domain due to a falsification on a copyright renewal. Observe the relevant page from the renewal:
As you can see it shows that Of Withered Apples was supposed to have been first published in volume 1, issue 33, of Uncanny Tales (July 1955).
So, I tracked down a copy of that comic book and am providing photographic evidence that it was not published in that issue.
Normally in these cases I would simply show the copyright page and/or the table of contents page. But as comics of that era often didn’t credit writers, and most also didn’t offer a table of contents page, this is impossible.
Instead, I have had the entire issue photographed, cover to cover, to show that Of Withered Apples was:

A comparison of the copyright renewal form HERE and the original publication of the short story, in Galaxy Science Fiction, September 1954 (below) proves that the copyright was not properly renewed.
Indeed, it appears that the copyright renewal was actually intentionally falsified so as to give the appearance that the story was still under copyright. An examination of the magazine from the issue where its renewers claim it to have been published DOES NOT CONTAIN the story.

This 4,712 word story may not be among Philip K. Dick’s best, but it is certainly worth looking at, and hearing!
Tony And The Beetles is a bit unusual too, having an almost juvenile or YA feel to it. Maybe that’s because it’s not nearly as horrific as many of Dick’s fantasy tales – there are some frightening elements, but the general tone is that of an ungroundedness. I see Tony And The Beetles as a kind of historical allegory and I’m not the only one. Phil Chevernet, the narrator who recorded it for LibriVox, wrote “I think [Dick] was commenting on imperialism in the 40s and 50s.” I think he’s right, but I think the comment is somewhat ambiguous, rather depressing, and almost wholly unhopeful. Dick grew up during World War II and little PKD was a very sensitive fellow, kind of like Tony.
Here’s the setup:
Young Tony Rossi has grown up on an alien world. As a child he’s known little else than bubble helmets, pressure suits, and robot pets. His playmates and schoolmates have all been the non-human children of the planet, but around him swirl the forces of history and when news of the ongoing war breaks Tony’s parents don’t seem to hold the same opinions of what it all means.

CBC Radio’s Ideas programme from August 19th, 2012 is entitled “Wired For Culture” and is a conversation with Professor Mark Pagel, the author of Wired For Culture: Origins Of The Human Social Mind. With host Paul Kennnedy the talk starts off discussing the differences between humans and apes (with non-human animals there is no accumulation of cultural technology or ideas). It’s an absolutely fascinating discussion. And it goes towards the relationship between ideas and copying of ideas – and hence copyright. Here’s the official description:

A live video of this year’s Worldcon Hugo Awards (Chicon 7: The 70th World Science Fiction Convention), held in Chicago, was being streamed on Ustream until shortly after clips from three Doctor Who episodes, an episode of Community, and a clip from last year’s Hugo Awards ceremony were shown. Neil Gaiman was giving his acceptance speech, for The Doctor’s Wife, when he was suddenly cut-off and replaced by a black screen and the words “Worldcon was removed due to violation of terms of service.”
Speculation by viewers, in the chat room associated with Ustream included surmises such as “Well, someone DCMA’d the Hugo live webcast” – and yet another chatter rightly pointed out that the clips used were “clearly FAIR USE.”
Things are clearly fucked up south of the border when a private “TERMS OF SERVICE” acts in place of copyright.
The next Hugo Awards ceremony should be released via torrent.
