Spark is an intelligent and informative radio show that brings me snappy interviews with clever folks who talk about technology and internet-related issues. I also really appreciate that CBC, the manufacturer, doesn’t try to control my sharing my purchase with my friends. Commentary: The Ethics Of Torrents

The Pirate Bay - Ethics

It’s screenshot of a torrent for an audiobook about ethics. The audiobook in question (one from Recorded Books’ The Modern Scholar series) is entitled Ethics, A History Of Moral Thought. It’s a course by Peter Kreeft, a professor of philosophy at Boston College and the uploader is listed as “anonymous”.

Why did he or she upload it?

Why did he or she do so anonymously?

Was uploading it wrong?

Am I wrong to download it?

Am I wrong to even point it out?

You may have answers to these questions. If you do they’re probably swirling around somewhere inside of you – but if they are of the sort of answers that are ready to latch on to just about any reasonable sounding analogy, the kind of analogy that matches the conclusion you want to come to, I’m betting they are the wrong answers.

If your answers to those questions don’t originate in your brain (figuratively) as much as they do your gut (again figuratively) we’d probably call those answers moral answers.

If, on the other hand, your answers have a structure to them, are logically argued towards (rather than just intuitively felt) and have some basis in experience we’d probably call those ethical answers.

Let’s go through the old argument:

1. Theft is wrong.
2. Using torrents is stealing.

3. Therefore torrents are wrong.

This argument sounds good. It is simple and has a morally satisfying conclusion.

But if the premises have something wrong with them, we must reject the conclusion.

The problem is with premise #2 .

Torrents are/is a technology, like podcasts and email. Technology doesn’t usually come in only one flavour, just good or wholly evil. Torrents are the same. Copyright owners torrent their own material – that isn’t wrong. Public domain material is torrented – that isn’t wrong. So torrents themselves aren’t the problem. Even if we associate 99% of all torrenting with wrongful behavior that doesn’t make the technology wrong. Etc. Etc.

So what is wrong exactly? Is it that copying is theft?

Let’s go through that argument:

1. Theft removes a thing from someone’s use.
2. Digital copying does not destroy the original.

3. Therefore digital copying is not stealing.

Makes sense right? So theft, at least the precise meaning of it isn’t the problem. How about this argument:

1. Harm is wrong.
2. To infringe upon copyrighting causes harm.
___________________________________
4. Therefore copyrights shouldn’t be violated.

I like this one. I think a lot of other people like it to. My only problem is with premise #2. What does it mean exactly?

Does it mean that someone is physically wounded? Clearly not. I’m betting this isn’t a physical thing at all. Maybe it is something else, or maybe it’s purely financial.

Is there a financial harm?

Maybe!

Let’s have a look at that one such argument:

1. Copyright generates revenue for copyright holders.
2. Infringing on copyright subverts copyright.
___________________________________
3. Therefore not infringing copyright helps copyright holders financially.

And if you believe #1 I’ll happily lease this post for 1¢ per day (minimum 100 days please). Premise #1 in the above argument just isn’t true. It can be true, but it sure doesn’t make for as compelling an argument:

1. Copyright can generate revenue for copyright holders.
2. Infringing on copyright subverts copyright.

3. Therefore not infringing copyright could help copyright holders financially.

That’s enough to start with.

If you would definitely not have paid for Ethics, A History Of Moral Thought would it have helped the copyright holder?

If you definitely would have paid for Ethics, A History Of Moral Thought, then why haven’t you?

If you once considered it, but didn’t buy it, I’m betting it is either price or convenience that’s prevented you.

Both can influence ethical arguments, but often don’t because they complicate matters.

Consider:

$38.95 on Audible (with DRM) – copyright remuneration UNKNOWN
$30.36 + shipping used on cassette (no DRM but inconvenient format) – copyright remuneration $0.00

FREE on ThePirateBay.org (with no DRM and no inconvenience) – copyright remuneration $0.00
FREE at your public library (variable formats and convienience) – copyright remuneration UNKNOWN

What we end up with is a lot of question marks. And if you suspect that the answers to the three UNKNOWNS above aren’t likely to be equal I agree with you. But what I find more interesting is that two of those $0.00 answers actually don’t generate any moral disgust in most people and I think that may be where our answer lies.

Yeah, I said it. The used versions of books are neither immoral nor unethical!

And why is it exactly that the arguments in favour of making the purchase of used books unethical have all failed to change our minds?

Now weigh those variable UNKNOWNS against these knowns:

Negatives regarding download of copyrighted material via torrent:

1. Copyright holders do not directly benefit monetarily.
2. You may be, depending on jurisdiction, in violation of a law – which may be scary.
3. You may feel guilty.

Positives regarding download of copyrighted material via torrent:

1. Convenience – torrents are fast and easy, they are often better labelled versions of the content, they lack DRM.
2. Price – torrents are free.
3. Intangibles – sharing makes you feel good, other torrent users benefit, copyright holders may benefit indirectly.

If our reasoning happens inside a big bag of blackness our reasoning is going to be poor. Ethics is hard. I’d like to hear some arguments.

Gods Of The North by Robert E. Howard

Gods Of The North, first published in 1934, is still just one of two Conan stories available on LibriVox.org (the other being Red Nails). Gods Of The North is a 3,500 word vignette, it’s been republished under the titles The Frost Giant’s Daughter and The Frost King’s Daughter. The reason it survives, and is known today, has nothing to do with marketing campaigns, intellectual property protection or lawyers. It survives for one reason alone – it survives because of it’s fans. In fact, it survives despite it being originally written as a piece for sale. It was actually rejected by Weird Tales magazine editor Farnsworth Wright:

Check it out… Gods Of The North was first published in a fan magazine (that had just sixty subscribers) – a fan magazine that counted both H.P. Lovecraft and Robert E. Howard among its feature (and letters column) contributors. Neither Lovecraft nor Howard wrote to, or for, THE FANTASY FAN because it was a profitable venture – they wrote to it, and for it, because they were themselves fans of fantasy and the stories and poems they were weaving. You may know the story. It’s a pretty famous one today, but it isn’t famous because it was a well marketed, properly licensed by the right’s holder, or branded. It is, instead, because it’s a good story that fans (another word for readers) appreciate.

Gods Of The North was nearly forgotten. It lay un-reprinted and virtually unknown for more than thirty years until it was re-discovered and reprinted in the December 1956 issue of Fantastic Universe. Here is the editorial introduction for that reprinting:

The publication of this strange story by Robert E. Howard, author of the Conan stories, so much a part of the Living Library of Fantasy, represents a departure for this magazine. Without abandoning our policy of bringing you, month after month, the best in NEW Science Fiction and Fantasy. We will, front time to time, publish material such as this, hitherto known to only a few students of the field! GODS OF THE NORTH was published in 1934, in Charles D. Hornig’s THE FANTASY FAN, which had a circulation of under a hundred! We thank Sam Moskowitz, Editor and SF historian, who showed us this story.

But the fan connection doesn’t end there. The artist most closely associated with the Marvel Comics run of Conan The Barbarian and Savage Sword Of Conan was John Buscema. But, he never illustrated an adaptation of Gods Of The North or The Frost Giant’s Daughter. And so it was up to fan artists, like the impressively talented Benito Gallego, to step in to imagine what a Buscema version of this fan favourite tale might look like. And he did it twice!

PHILIP K. DICK (1928 -1982) explored personal, religious, sociological, political and philosophical themes in his Science Fiction and Fantasy short stories.

This post is a complete listing of every known Philip K. Dick short story published between 1952 and 1963. Many of them are in the public domain. The known PD titles are all listed. The unknown ones and the ones we aren’t sure about are listed too. My hope is that this list will help bring more of the public domain PHILIP K. DICK stories out into the open (and thus be turned into audiobooks).

Beside each story title I have made a series of notes and links:

First up is the original publication (mostly magazines, but there are a few anthologies). Next is the public domain status (if known). Then there is a link to the Wikipedia entry for the story (indicated by the “W”) when available. If the story is PD then I’ve provided a link to either the Project Gutenberg etext or the SickMyDuck equivalent (if PG doesn’t have it). Those links are represented as either “PG” or “SD”. Everything Is A Remix

Here’s a really terrific project that illustrates, in a very succinct way, the history of creativity. It’s thesis is that there is a fundamental through-line which connects all human creation and that is to copy, modify and mix (or remix) the creations of the past to make something new.

One example, not cited in the series so far, is this thread of remixing:

Edward Bellamy’s Looking Backward (1888) -> David Butler’s Just Imagine (1930) -> C.M. Kornbluth’s The Marching Morons (1951) -> Mack Reynolds’ Looking Backward From The Year 2000 (1974) -> Robert A. Heinlein’s For Us, The Living (written in 1938, published 2003) -> Mike Judge’s Idiocracy (2006)

In fact, we recently posted an audiobook reading of C.M. Kornbluth’s The Marching Morons, which took inspiration from the 1930 film Just Imagine. Robert A. Heinlein’s first novel (which went unpublished until 2003) was also a response to this movie. But Just Imagine itself likely took its inspiration from Edward Bellamy’s immensely popular 1888 utopian novel Looking Backward 2000-1887. Science Fiction writer, Mack Reynolds, wrote a couple sequels to Looking Backward but he wasn’t alone – in fact more than a dozen sequels, responses and inspired works followed. The history of Science Fiction is a flowing and knotted tapestry of scientific discovery, theory, ideology, adventure, and drama that cannot be summed up with any simplistic bag with the names like “inspiration” or “genius.”
